1. Acceptance of Terms
By accessing and using Arbitr's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our service.
2. Description of Service
Arbitr provides a cryptocurrency escrow service that enables sellers to securely receive payment for digital assets. When a buyer completes payment, our system automatically releases the digital files to the buyer.
We act as a neutral third party holding funds in escrow until transaction conditions are met. We do not take ownership of funds or files at any point.
3. Service Fees
Arbitr charges a service fee of 5% on completed transactions. This fee is deducted from the transaction amount before the remaining funds are released to the seller.
Network fees (gas fees, transaction fees) are paid by the buyer and are separate from our service fee.
4. User Responsibilities
As a user, you agree to:
- Provide accurate information when creating deals
- Ensure you have the legal right to sell any digital assets
- Use the service for legitimate purposes only
- Not attempt to reverse engineer or exploit the service
- Maintain the security of your wallet and private keys
- Comply with all applicable laws and regulations
5. Prohibited Uses
You may not use our service for:
- Any illegal or unlawful purpose
- Sale of stolen or illegally obtained content
- Money laundering or terrorist financing
- Fraud or deceptive practices
- Sale of goods or services prohibited by applicable law
- Content that infringes intellectual property rights
- Any form of harassment, abuse, or harm
6. Transaction Process
The transaction process works as follows:
- Seller creates a deal with price and uploads digital files
- Seller receives a unique deal link to share with buyers
- Buyer sends payment to the escrow address
- Our system detects payment on the blockchain
- Files are automatically released to the buyer
- Seller receives payment (minus service fee)
7. Payment & Refunds
All cryptocurrency transactions are irreversible once confirmed on the blockchain. If a dispute arises, we may attempt mediation but cannot guarantee refunds as cryptocurrency transactions cannot be reversed.
Refunds are handled on a case-by-case basis at our sole discretion and may only be processed if funds remain in escrow.
8. Intellectual Property
Arbitr retains all rights to our service, including our website, software, and branding. Users retain ownership of their digital files but grant us license to store and transfer them as part of our escrow service.
You represent that you have all necessary rights to sell any content you list through our service.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARBITR IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
10. Indemnification
You agree to indemnify and hold Arbitr harmless from any claims, damages, losses, or expenses (including attorney fees) arising from your use of our service or violation of these terms.
11. Dispute Resolution
Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with applicable rules. You waive any right to participate in class actions or representative proceedings.
12. Termination
We reserve the right to terminate or suspend your access to our service at any time for any reason, including violation of these terms. Upon termination, your right to use the service ceases immediately.
13. Age Requirements
You must be at least 18 years old (or the age of majority in your jurisdiction) to use our service. By using our service, you represent that you meet this requirement.
14. Changes to Terms
We may modify these terms at any time. Continued use of our service after changes constitutes acceptance of the new terms. We will notify users of material changes via our website.
15. Governing Law
These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
